I have just sent this to Cryptic, and as a result you will not be seeing me in game ever again most likely.
I wanted you, my friends in the SG to know out front that IF I do not return due to this, I have enjoyed playing the game alongside each and every one of you.
If it comes to a Lawsuit which I sadly believe it will, if anyone wishes to be contacted and added to the list, drop me an email at the address in the message.
-----------
This ticket is to make Cryptic aware that it is my intention to start a possible Class Action lawsuit against Cryptic and their partner Atari for gross negligence, unfair practices and fraud.
1) People STILL posting on Cryptic's own Forums are bragging about getting to play for FREE despite having canceled their account.
2) Even those Cryptic HAS shut out from the game had received at minimum 2 FREE weeks while myself and other subscribers paid for the same service. People STILL able to play are now in their FIFTH week of free play time, over a $14.99 value as described by Cryptic for a subscription.
3) As a test, I canceled my account on 10/30/09. Due to a free day given by Cryptic, my account was active until 11/02/09. As of today, 11/03/09, I am (As should be) unable to access the game or forums.
What the above facts show is that Cryptic has willingly allowed people to receive free time while I was made to pay for the same service. It also shows that now Cryptic HAS begun to enforce their rules, but have made no attempt at reparations to their players for continuing to be charged for a product others received free of charge.
At the very least, I and other subscribers should have received either the SAME 2 to 5 weeks others got for free, or a refund of our subscription fees to account for Cryptic's inability to enforce their own rules.
I hold no hopes that Cryptic willingly does the right thing, and refunds those fees collected while a significant amount of people received the same product free of charge. However, I will give Cryptic one week from this date - 11/03/2009 to make this correct.
If after that time I have not received either 2 to 5 free weeks in accordance to established pattern or a refund of my $14.99 fee that was paid in good faith, I will be escalating this issue to my lawyer, and seeking others who have also been affected by this issue to begin a Class Action lawsuit.
